Terms of Use, Privacy Policy, Refund & Shipping Policy, and Arbitration Agreement

THIS AGREEMENT CONTAINS A BINDING ARBITRATION PROVISION AND A CLASS ACTION WAIVER. PLEASE READ IT CAREFULLY. ALL SALES ARE FINAL. NO REFUNDS OR EXCHANGES WILL BE ISSUED.

1. Agreement Between You and Pulsor®

This website and any related websites, applications, digital platforms, products, content, and services (collectively, the “Site”) are operated by Pulsor Wellness, LLC, a Wyoming limited liability company (referred to as “Pulsor®,” “we,” “us,” or “our”). Pulsor® is an online business and does not maintain a physical retail storefront. Any affiliated or related entities may provide services on Pulsor®’s behalf, but Pulsor Wellness, LLC is the sole entity entering into this Agreement with you.

By accessing, browsing, creating an account, purchasing, or otherwise using the Site, you acknowledge that you have had reasonable notice of this Agreement and agree to be legally bound by its terms, including the Refund Policy (Section 12), Shipping Policy (Section 13), and Arbitration Agreement (Section 10). If you do not agree, you must not access or use the Site.

2. Changes to This Agreement

We may update this Agreement from time to time. If we make material changes, we will provide reasonable notice, such as by posting an updated version on the Site or through other appropriate means.

Your continued use of the Site after changes become effective constitutes acceptance of the revised Agreement. Changes to Section 10 (Arbitration and Class Action Waiver) will apply only as permitted by applicable law.

3. Third-Party Links

The Site may contain links to third-party websites or services not owned or controlled by Pulsor®. Pulsor® is not responsible for the content, policies, or practices of any third party. Access to third-party sites is at your own risk.

4. Permitted and Prohibited Use

You agree to use the Site only for lawful purposes and in accordance with this Agreement. You may not:

5. Communication Services and User Conduct

If the Site provides forums, message boards, chat features, or other interactive services, you agree not to submit content that is unlawful, misleading, defamatory, infringing, obscene, abusive, or otherwise objectionable.

Pulsor® may, but is not required to, monitor or remove content and may restrict access where reasonably necessary to protect users, the Site, or legal compliance.

6. User Content

You retain ownership of content you submit to the Site (referred to as “Submissions”). By submitting content, you grant Pulsor® a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and otherwise use your Submissions solely in connection with operating, improving, and promoting the Site.

You represent and warrant that you have all rights necessary to submit your content and that it does not violate this Agreement or any applicable law.

7. Disclaimers

THE SITE AND ALL CONTENT, INFORMATION, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

THE SITE DOES NOT PROVIDE MEDICAL, LEGAL, FINANCIAL, OR PROFESSIONAL ADVICE. ALL INFORMATION IS PROVIDED FOR GENERAL INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE RELIED UPON AS A SUBSTITUTE FOR PROFESSIONAL ADVICE FROM A QUALIFIED PROVIDER.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PULSOR® SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE.

IN NO EVENT SHALL PULSOR®’S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO PULSOR® (IF ANY) DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Nothing in this Agreement limits liability that cannot be excluded under applicable law.

9. Termination

Pulsor® may suspend or terminate your access to the Site if you violate this Agreement or applicable law. Provisions that by their nature should survive termination shall survive, including arbitration, limitation of liability, and governing law.

10. Binding Arbitration and Class Action Waiver

a. Agreement to Arbitrate. Any dispute, claim, or controversy arising out of or relating to this Agreement, your use of the Site, or your relationship with Pulsor® shall be resolved exclusively by binding individual arbitration and not in a court of law.

b. Arbitration Provider and Rules. Arbitration shall be administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules, as modified by this Agreement. Arbitration may be conducted remotely unless otherwise required by law.

c. Costs and Fees. Pulsor® will pay arbitration filing fees in accordance with applicable AAA consumer rules. Each party will bear its own attorneys’ fees unless an award of fees is authorized by applicable law.

d. Class Action Waiver. You agree that any dispute will be brought only on an individual basis. You waive any right to participate in a class action, collective action, or representative proceeding.

e. Opt-Out Right. You may opt out of this arbitration agreement within thirty (30) days of first accepting this Agreement by emailing legal@pulsor.global with your name and a clear statement that you wish to opt out of arbitration. Opting out will not affect the remainder of this Agreement.

f. Governing Law. This arbitration agreement is governed by the Federal Arbitration Act.

11. Privacy Policy

This section describes how Pulsor Wellness, LLC collects, uses, shares, and protects personal information when you visit or make a purchase through the Site. By using the Site, you consent to the practices described below.

Each provider is contractually obligated to use your data only for the purposes described above and to maintain appropriate security measures. For details on how these providers handle your data, please refer to their respective privacy policies.

You may control or disable cookies through your browser settings. Disabling cookies may affect the functionality of the Site. If you are located in the European Economic Area (“EEA”), United Kingdom, or another jurisdiction that requires opt-in consent for non-essential cookies, we will obtain your consent before placing non-essential cookies on your device.

e. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this policy, comply with legal obligations, resolve disputes, and enforce our agreements. Order records and transaction data are retained for a minimum of seven (7) years for tax and accounting purposes. You may request deletion of your personal data at any time (see “Your Rights” below), subject to legal retention requirements.

Depending on your location, you may have the following rights regarding your personal information:

For California residents (CCPA/CPRA): You have the right to know what personal information we collect, the right to request deletion, and the right to opt out of the sale of personal information. We do not sell personal information. To exercise your rights, contact us at privacy@pulsor.global. We will not discriminate against you for exercising your privacy rights.

For EEA/UK residents (GDPR): Our legal basis for processing your personal information includes performance of a contract (order fulfillment), legitimate interests (Site operation, fraud prevention), consent (marketing communications, non-essential cookies), and legal obligation (tax and accounting records). You may lodge a complaint with your local data protection authority if you believe your rights have been violated.

To exercise any of these rights, contact us at privacy@pulsor.global. We will respond within 30 days (or as required by applicable law).

g. Children’s Privacy

The Site is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that we have collected personal information from a child under 13, we will take steps to delete that information promptly. If you believe a child under 13 has provided us with personal information, please contact us at privacy@pulsor.global.

h. Security

We implement reasonable administrative, technical, and physical safeguards to protect personal information from unauthorized access, use, or disclosure. Payment card information is processed directly by Stripe using industry-standard encryption (TLS/SSL) and is never transmitted to or stored on our servers. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.

i. International Transfers

Your information may be transferred to and processed in the United States or other countries where our service providers operate. By using the Site, you consent to such transfers. Where required by law, we ensure appropriate safeguards are in place for international data transfers.

12. Refund and Return Policy

ALL SALES ARE FINAL. NO REFUNDS, RETURNS, OR EXCHANGES WILL BE ISSUED.

By completing a purchase on the Site, you acknowledge and agree that all sales of Pulsor® products including physical products and digital products are final. Pulsor® is an online business and does not maintain a physical retail location; there is no facility to accept in-person returns. Pulsor Wellness, LLC does not offer refunds, returns, exchanges, or store credit for any reason, including but not limited to:

Damaged or Defective Items. If you receive a product that is damaged during shipping or is materially defective upon arrival, please contact us within seven (7) days of delivery at orders@pulsor.global with your order number and photographs of the damage or defect. Pulsor® will review your claim and, at our sole discretion, may offer a replacement of the same product. Replacements are subject to product availability.

Non-Delivery. If your order does not arrive within the estimated delivery window, please contact us at orders@pulsor.global. We will work with the shipping carrier to locate your package. If the package is confirmed lost by the carrier, Pulsor® will, at our sole discretion, reship the order or issue a one-time replacement.

Chargebacks. By agreeing to this policy, you acknowledge that initiating a chargeback or payment dispute with your bank or credit card provider for a purchase that was legitimately authorized and fulfilled constitutes a breach of this Agreement. We reserve the right to contest any chargeback and to suspend or terminate your account.

This Refund and Return Policy is presented to you before checkout and your agreement is required to complete any purchase. This policy does not affect any rights you may have under applicable consumer protection laws that cannot be waived by agreement.

13. Shipping Policy

Shipping Carrier. All physical orders are shipped via the United States Postal Service (USPS). Pulsor® does not currently offer alternative carriers.

Shipping Costs. Shipping costs are calculated at checkout and are the responsibility of the customer. Shipping rates are determined by USPS based on package weight, dimensions, and destination. Shipping charges are non-refundable.

Processing Time. Orders are typically processed within 3–5 business days after payment is confirmed. Processing times may vary during periods of high demand or unforeseen circumstances. You will receive a confirmation email when your order has been placed and, when applicable, a notification when your order has shipped.

Estimated Delivery. Delivery times depend on the USPS service level selected at checkout and the destination address. Typical domestic (U.S.) delivery ranges from 3–4 business days after shipment. International delivery times vary by destination and may take 1–4 weeks depending on shipment sppeds and customs. These are estimates and not guarantees; Pulsor® is not responsible for carrier delays.

Order Tracking. When a tracking number is available, it will be included in your shipping confirmation email. You can track your package directly through the USPS website at usps.com/track.

International Orders. International customers are responsible for any customs duties, import taxes, or brokerage fees imposed by their country. These charges are not included in the product price or shipping cost and are collected by your local customs authority upon delivery. Pulsor® is not responsible for delays caused by customs processing.

Incorrect Shipping Address. Please verify your shipping address carefully before completing your order. Pulsor® is not responsible for orders shipped to an incorrect address provided by the customer. If a package is returned to us due to an incorrect address, reshipment will be at the customer’s expense.

Lost or Damaged Packages. If your package appears to be lost or arrives damaged, please contact us at orders@pulsor.global within seven (7) days. We will coordinate with USPS to file a claim and resolve the issue. See Section 12 for our policy on damaged or defective items.

Digital Products. Digital products are delivered electronically and are not subject to shipping charges or delivery timelines. Access details will be provided via email after your purchase is confirmed.

14. Governing Law

Except where prohibited by law, this Agreement shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict-of-law principles. Pulsor Wellness, LLC is a Wyoming limited liability company.

15. Severability

If any provision of this Agreement is held unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

This Agreement—including the Terms of Use, Privacy Policy, Refund and Return Policy, Shipping Policy, and Arbitration Agreement contained herein—constitutes the entire agreement between you and Pulsor® regarding the Site and supersedes all prior agreements or communications.
